Family law matters in Brampton are heard at the A. Grenville & William Davis Courthouse at 7755 Hurontario Street. Both the Ontario Court of Justice and the Superior Court of Justice sit there. Divorce applications and property claims must be started in the Superior Court of Justice, while parenting and support matters can be brought in either court.
Most divorces in Ontario are granted on the basis of a one-year separation. You can start your application before the year is over, but the divorce cannot be granted until the full year has passed. You do not need your spouse’s permission or agreement to separate, and you may be considered separated even while living in the same home.
An uncontested divorce — often called a simple divorce — means both spouses agree on parenting, support, and property, or one spouse does not respond. It is usually a paperwork process with no court appearance. A contested divorce means there are unresolved disagreements that may require negotiation, mediation, court motions, or, in rare cases, a trial.
You are not legally required to have one, but a properly drafted separation agreement is the most reliable way to settle parenting arrangements, support, and the division of property. Banks often require one before approving a new mortgage, and it can be enforced by the court if either party does not follow it.
For married spouses, Ontario’s Family Law Act requires an equalization of net family property — the spouse whose wealth grew more during the marriage generally pays the other half the difference. The matrimonial home follows special rules. Common-law couples do not automatically share property, so getting advice early is especially important.
Ontario court filing fees for a divorce are approximately $669, subject to change. Legal fees depend on how much is disputed: an uncontested divorce costs far less than a contested one. We explain fees clearly at your free consultation, before any work begins.
